Terms of Service (Recomil)

Note: The Japanese version is the authoritative version. In case of any discrepancy, the Japanese version shall prevail.

These Terms of Service (hereinafter “these Terms”) set forth the conditions for use of the app “Recomil” and related services (hereinafter “the Service”). Users shall use the Service upon agreeing to these Terms.

Article 1 (Application)

  1. These Terms apply to all relationships between the Operator and users regarding the use of the Service.
  2. Rules and regulations (hereinafter “Individual Provisions”) established by the Operator on the Service or separately constitute part of these Terms.
  3. In case of conflict between these Terms and Individual Provisions, the Individual Provisions shall prevail.

Article 2 (Definitions)

  1. “User” means an individual or legal entity that uses the Service.
  2. “Paid Plan” means paid features provided as a subscription.
  3. “In-App Purchase” means payment through the Apple App Store or Google Play (hereinafter “Stores”).

Article 3 (Terms of Use and Age)

  1. Users shall agree to these Terms and use the Service accordingly.
  2. The Service is not intended for persons under 13 years of age. Persons under 13 may not use the Service.
  3. Minor users shall obtain consent from their legal guardian before using the Service.

Article 4 (Account)

  1. Account registration may be required to use the Service.
  2. Users shall manage their account information at their own responsibility and prevent use by third parties.

Article 5 (Usage Fees, Payment, and Auto-Renewal)

  1. Paid Plans for the Service are provided through In-App Purchases.
  2. Billing terms (fees, periods, content, availability of free trials, etc.) shall follow the display on the Stores or guidance from the Operator.
  3. Subscriptions are automatically renewed until cancelled by the user. The applicable fee at the time of renewal will be charged through the Store.
  4. Payments are processed by the Stores, and the Operator does not retain payment information (credit card numbers, etc.).

Article 6 (Free Trials, etc.)

  1. The Operator may offer promotions such as free trials.
  2. Upon expiration of the free period, automatic transition to a Paid Plan may occur. If you do not wish to continue, please cancel by the deadline following the Store’s procedures.
  3. Conditions for free trials shall follow the display on the Stores.

Article 7 (Cancellation and Refunds)

  1. Cancellation of subscriptions shall be made by users through the Store’s procedures. The Operator cannot cancel on behalf of users.
  2. Deleting your account or the app does not automatically cancel your subscription.
  3. Refunds are subject to the Store’s refund policy and applicable laws. The Operator will respond in accordance with the refund procedures provided by the Stores.

Article 8 (Prohibited Activities)

Users shall not engage in the following activities:

  1. Acts that violate laws or public order and morals
  2. Unauthorized access, tampering, reverse compilation, or similar acts
  3. Acts that infringe upon the rights of the Service or third parties
  4. Acts that interfere with the operation of the Service
  5. Acts deemed inappropriate by the Operator

Article 9 (Intellectual Property Rights)

All intellectual property rights related to the Service belong to the Operator or legitimate rights holders.

Article 10 (User Posts, etc.)

  1. If the Service provides posting or transmission features, users shall use them at their own responsibility.
  2. Rights and responsibilities regarding posted content belong to users.

Article 11 (Disclaimer of Warranty)

The Operator makes no express or implied warranties regarding the absence of defects in the Service, fitness for a particular purpose, continuity, or other matters.

Article 12 (Limitation of Liability)

  1. Except in cases of intentional misconduct or gross negligence by the Operator, the Operator shall not be liable for damages arising from the use of the Service.
  2. Even if the Operator is held liable, the amount of compensation shall be limited to the amount of usage fees paid by the user to the Operator in the month when the damage occurred. However, this limitation does not apply where restricted by the Consumer Contract Act or other laws.

Article 13 (Changes, Suspension, and Termination of Service)

The Operator may change the content of the Service, suspend provision, or terminate the Service with or without prior notice to users.

Article 14 (Suspension of Use and Account Deletion)

The Operator may suspend use or delete accounts when a user violates these Terms or when the Operator deems it inappropriate.

Article 15 (Handling of Personal Information)

The Operator handles users’ personal information in accordance with the Operator’s Privacy Policy.

Article 16 (Changes to Terms)

  1. The Operator may change these Terms.
  2. In the case of significant changes, the Operator shall provide advance notice through appropriate means.

Article 17 (Governing Law and Jurisdiction)

These Terms shall be governed by Japanese law, and disputes related to the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Operator’s head office.

Article 18 (Language)

The Japanese version of these Terms shall be the official text. In case of any discrepancy between the Japanese and English versions, the Japanese version shall prevail.
